Secretary of States office sued over title change

Conservatives have sued the Secretary of States office over a change in the title for an amendment for the fall election relating to the marriage amendment. The office claims the title change reflects more accurately the subject matter but conservatives charge that the secretary does not have the authority to change the title and further accuse the secretary of using his office to influence the outcome of the amendment. As far as I know only the legislature has the authority to make such changes.
